This privacy statement explains how Carrièreladder treats data of an identified or identifiable natural person. Carrièreladder respects the privacy of (potential) clients, associates and visitors to the website and ensures that the personal information you provide Carrièreladder is processed in accordance with applicable laws and regulations for the protection of personal data and is treated confidentially. This privacy statement may be amended in the future. Therefore, please regularly check the privacy statement on the website of Career Ladder. It can be found at the bottom of the website.

1. From whom does Carrièreladder process personal data?

Carrièreladder processes personal data of the following categories of persons:

  • (potential) clients;
  • visitors of www.carrièreladder.nl;
  • recipients of newsletters from Carrièreladder;
  • participants in (online) training and coaching services of Carrièreladder;
  • all other persons who contact Carrièreladder to build a business relationship.

2. Objective of processing personal data

Carrièreladder processes the data you provide for the following purposes:

  • Carrying out a contract of assignment to provide career development training and coaching services. This includes processing and handling payments for coaching services purchased;
  • Complying with any legal obligations, such as tax laws and regulations;
    Managing the relationship file of Career Ladder;
  • Carrying out (targeted) marketing and promotional activities and/or events to establish, maintain or expand a relationship with (potential) clients, including through market research or sending newsletters or information of a specific nature;
  • To personalise the website for you and recommend services that may be of interest to you;
  • To allow you to create and manage an account;
  • To evaluate Carrièreladder’s services and/or trainings (such as a workshop), based on evaluation forms completed by participants;
  • To send you a newsletter to which you personally subscribe via the website of Career Ladder. If you no longer appreciate this, you can let us know by sending an e-mail to marjan@carriereladder.nl.
  • To further develop and improve the website. Website user statistics provide information about the number of visitors, the duration of the visit, which parts of the website are viewed and the click behaviour. Based on the user statistics, Carrièreladder can see whether the current website is functioning properly. If Carrièreladder sees that certain parts need improvement, Carrièreladder adjusts the website accordingly. These are generic reports that cannot be traced back to individual visitors.

3. How does Carrièreladder obtain your personal data?

Processing of personal data takes place on the basis of data that:

  • you have provided yourself: This may be in person (e.g. during a meeting or training), by telephone, or digitally via e-mail, web forms or other digital channels. Examples include contact details and – depending on the assignment – additional personal data;
  • automatically collected during your website visit or when reading digital newsletters: This includes data such as your IP address, surfing behaviour on the website (including data about the first, previous and current visit, pages viewed and navigation behaviour), and interactions such as click behaviour on specific parts of the website;
  • derived from other sources: This includes data obtained via (business) social media platforms (such as LinkedIn and Instagram), public business websites, and the trade register of the Chamber of Commerce. Examples include contact details and other relevant personal data.

4. What personal data does Carrièreladder process?

Carrièreladder processes personal data necessary for the performance of its services, administration and other purposes. The data processed are divided into the following categories:

a. For services and administration:

  • Contact details: Name, address, phone number, email address.
  • Personal data: Age, date of birth, gender, nationality, marital status, family composition.
  • Work-related data: Position, employer, employment history.
  • Special personal data: Medical data (only if necessary for the provision of services and with your explicit consent).

b. For other purposes, such as website management and marketing:

  • Technical data: IP addresses, location data and cookies.
  • Contact details: E-mail address and telephone number.

c. Legal basis of processing

Career Ladder processes personal data on the following legal grounds:

  • The performance of the contract of assignment to provide career development training and coaching services;
  • A legal obligation for the proper performance of administration and tax returns as well as their storage;
  • Your explicit consent for specific purposes, which can be revoked by you at any time, without prejudice to the lawfulness of the processing based on the consent before revocation;
  • A legal obligation;
  • A legitimate interest, such as the use of contact data for inviting you to a meeting (such as a workshop) or sending you the business newsletter.

 5. Data retention

Personal data will not be retained longer than strictly necessary. The following retention periods are used in principle:

  • Assignment files are kept for 7 years after completion of the assignment.
  • Data provided via the website or via e-mail that do not lead to an agreement will be deleted within 30 days after the first contact.
  • Recipients of newsletters and invitees to coaching services will remain registered for 5 years after unsubscribing, unless you object earlier. In that case, your data will be deleted immediately.

6. How does Carrièreladder handle confidentiality and disclosure of data to third parties?

The data you provide will be handled with care. Your data will not be sold to third parties and will only be shared in the following cases:

a. when this is necessary for the performance of an agreement; or
b. in order to comply with legal obligations.

When external parties are engaged to process your data, a processing agreement is concluded. This ensures that your data is given the same level of security and confidentiality as within their own organisation.

All third parties engaged are obliged to treat your data confidentially and take adequate security measures.

7. Data security

Carrièreladder shall ensure that, given the state of the art, the security of personal data is sufficient to prevent, as far as possible, unlawful processing, unauthorised access, modification, disclosure or loss of the data.

Mandatory data breach notification

When personal data ends up in the hands of unauthorised persons, we speak of a data breach. In practice, this often happens when a laptop, phone or USB stick is accidentally left behind in public transport or another public place, or when these devices are stolen.

If a data breach leads to a significant likelihood of serious adverse consequences for the protection of personal data, or if these consequences have already occurred, the data breach is reported to the Personal Data Authority (AP).

In addition, the data subjects, whose data has been leaked, will be informed if the leak is expected to have, or may have, adverse effects on their personal privacy. This is done unless there are compelling reasons to refrain from reporting.

8. Transfer outside the EEA

In principle, Carrièreladder does not transfer personal data to countries outside the European Economic Area (EEA). If this should nevertheless be necessary, Carrièreladder ensures that the transfer only takes place if the European Commission has indicated that the country in question offers an adequate level of protection or if there are adequate safeguards within the meaning of the General Data Protection Regulation (AVG).

9. Rights, questions and complaints

As a data subject, you can access, correct and/or delete your data. You also have the right to restrict the processing of your data or to transfer your data to another party. In the unlikely event that you do not agree with the way your data is processed by Carrièreladder and/or have other objections regarding the processing of your personal data, you can object to this.
